The holiday season, often seen as a time of joy and togetherness, can become a contentious period for divorced or divorcing parents who cannot agree on where their children will spend the holidays. The Courts prioritize the best interests of the child while addressing holiday visitation disputes, but it is always ideal for parents to work together to resolve this issue prior to seeking judicial intervention.


Parents should work together to create a mutually agreeable holiday schedule during their divorce proceedings. These schedules can include alternating holidays, splitting the day, or designating certain holidays for one parent and others for the other parent.   If parents cannot reach an agreement, the court will intervene. Judges aim to ensure that the child maintains meaningful relationships with both parents while considering the child’s needs and traditions.
