WHAT EXACTLY IS SPOUSAL MAINTENANCE?

Spousal maintenance, also called spousal support or alimony, is a structured payment plan designed to protect separated couples financially. Maintenance ensures that both parties are recognized for their contribution to the marriage and rewarded accordingly. Maintenance involves the one party, whoever was the family’s primary income earner, giving financial support to the other party, whose income alone is not enough.

HOW IS SPOUSAL MAINTENANCE CALCULATED?

There are many different factors that the court considers when awarding maintenance. The length of the marriage, the individuals’ contributions to the marriage, and financial standings at the time of separation are a few of the questions considered. Payment plans differ widely, from lump sums to yearly payments, and monthly payments to weekly payments.

Many other considerations exist, as well. Spousal support payments are a special tax item for both parties, and you might need legal advice to decide what payment plan is best based on your contribution and tax bracket. Whether you are starting payments now or have been involved in maintenance payments for some time, you should be aware of legal obligations regarding when payments end, for what payments can be used and what forms of payment are required or prohibited.
