Going through a divorce is often a very emotional and trying experience for many litigants. In addition to the emotional stress, there is also the financial stress cause by a divorce. However, as litigants, you and your spouse are in control of how stressful and costly your divorce proceeding will be. Not all divorces must be contentious and proceed to trial. There are benefits to amicably resolving your matter.
One such benefit is that you will control the outcome of your divorce. You and your spouse will negotiate and agree upon the terms of your agreement - - the parties control their own fates. As with any negotiation, there is give and take. If your matter proceeds to a trial, the judge will be determining the outcome of your divorce. The judge will apply the letter of the law to your divorce and you or your spouse may be dissatisfied with the result, which could lead to an appeal.
An additional benefit is a lower financial cost. Litigating your matter and proceeding to trial is time intensive,stressful and costly. In some cases, experts need to be retained and testify. There is a cost associated with their reports and testimony. There is also the cost for your attorney to prepare for trial. As part of the trial preparations, your attorneywill not only need to prepare themselves so they know all of the ins and outs of your case, but they must also prepare you for trial.
Amicably resolving your matter is lessstressful than proceeding to a trial. There is a sense of closure when you enter into your agreement because you know the terms that were negotiated and agreed to. This is unlike a trial where you will not know how the Court will rule until you receive the decision after trial. There is the added benefit of not having to prepare for trial and testifying during trial.
