When someone violates the terms of a Stipulation of Settlement in New York, the aggrieved party can file a motion in court to enforce the agreement. The court may find the violating party in contempt if the breach is willful and order sanctions, fines, or even incarceration in extreme cases.
Depending on the nature of the violation, the court can also direct compliance, award attorney’s fees, or modify the original order. In family law cases, violations involving custody, visitation, or support can have serious consequences, including loss of parenting time or wage garnishment.
