TIPS TO FOLLOW IF YOUR SPOUSE IS UNRELIABLE AND DOESN’T PAY CHILD SUPPORT ON TIME

Dealing with an unreliable ex-spouse who doesn't pay child support on time can be stressful, especially when you're trying to maintain stability for your child. Fortunately, New York State has systems in place to help custodial parents enforce child support orders and ensure payments are made.
1. Contact the Child Support Enforcement Unit (CSEU): If your child support order is handled through the Support Collection Unit (SCU), the Child Support Enforcement Unit can take steps to collect late or missing payments. This includes wage garnishment, tax refund interception, and even suspending the non-paying parent’s driver's license or passport.
2. Keep Detailed Records: Track every payment — or missed payment — along with any communication related to child support. This documentation will be essential if you need to return to court or prove noncompliance.
3. File a Violation Petition in Family Court: If your ex repeatedly fails to pay, you can file a “violation petition” in Family Court. A judge can order payment of arrears and may impose penalties, including jail time, for willful non-payment.
