What do I do if my ex-spouse is not paying me child support?


During and after any court proceedings dealing with payments it is extremely smart to keep a log of all payments that are missed or not paid to you. If there are outstanding payments due to you, you may bring on a violation petition in the Family Court for any of those arrears.


In that petition you will have to explain what the court ordered payments are that your ex-spouse is supposed to pay and what payments have been missed. Once a judge is assigned to your case you can bring forward your evidence as to the payments that are due to you. As long as the payments were court ordered payments from a prior order of the court, the court will order your ex-spouse to pay the arrears.
